Re: Rented Units – Declaration Details

Dear Owners,

During the purchase of your unit, you were provided with a Disclosure Statement, which included

the proposed Declaration. Now that Matrix Development has officially registered Westgate as

Wentworth Standard Condominium Corporation No. 657 (WSCC 657), that Disclosure Statement is

now referred to as the Declaration. This document, along with the Bylaws and Rules & Regulations,

forms the governing documents of the Corporation.

Given the location of this building and its proximity to post-secondary institutes, it is our

expectation that this building will be comprised primarily of units that are not owner-occupied.

With this in mind, we wanted to take a moment to remind you of the stipulations outlined in the

governing documents surrounding leasing of Residential Units, Parking Units, and Locker Units.

1) Leases must be no less than 6 consecutive months (Section 20:a)

2) The owners must provide a copy of the Declaration, Bylaws, Rules & Regulations to the

lessee. [Section 20:b(i C)].

3) Within 10 days of entering into the lease or renewal agreement, and prior to it’s

commencement provide the corporation with notice that their unit is leased, completed

Resident Information Form, and a copy of the lease/renewal agreement. [Section 20:b(i A-

B)]. Within 10 days of the lease being terminated or not renewed, the owner is required to

advise the Corporation. [Section 20:b(ii)]. Please refer to Section 20 of the Declaration for

information.

4) The behaviour of your tenants, including their guests, are the responsibility of the Owner

[Section 16:b]. It is the responsibility of the Owner to provide the corporations Declaration,

Bylaws, Rules and Regulations to the tenants. Any violations of these governing documents

or damage to the Common Element are the owners responsibility to resolve to the

Corporations satisfaction.5) Entry Door locks cannot be changed. They must remain on the master key system. (Section

31)

6) Parking Units can only be rented to current residents of Westgate Condominiums. The

rental term cannot exceed the term of the residential tenancy [Section 15:a(ii)]. It is the

responsibility of the Owner to provide the corporations Declaration, Bylaws, Rules and

Regulations to the lease. Any violations of these governing documents or damage to the

Common Elements are the owners responsibility to resolve to the Corporations satisfaction.

Please refer to Section 18a of the Declaration for information regarding types of vehicles

permitted, and their state of operation.

7) Locker Units can only be rented to current residents of Westgate Condominiums. The rental

term cannot exceed the term of the residential tenancy [Section 15:a(ii)]. It is the

responsibility of the Owner to provide the corporations Declaration, Bylaws, Rules and

Regulations to the tenants. Any violations of these governing documents or damage to the

Common Element are the owners responsibility to resolve to the Corporations satisfaction.

It is the lease holder’s responsibility to retain content insurance for the belongings stored

in the locker (Section 28). Please refer to Section 18b of the Declaration for information on

what can be stored in the locker.

Please also be reminded that tenants should carry content insurance for their own belongings

within the unit. The Corporation is not responsible for any damage to personal belongings or

betterments within unit boundaries.

The general maintenance and repair of your unit (outlined in Section 4) is not the responsibility of

WSCC657. Any construction deficiencies should be communicated directly to Matrix

Developments. Management is happy to work with your tenants to resolve minor common

element issues that impact them, such as reprogramming fobs, changing contact information in

access controls, booking the elevator, etc., and appreciates any concerns regarding the Common

Element brought to the attention of Management.

Elevator bookings are available Monday to Friday only, between the hours of 10:00 a.m. – 1:00

p.m. or 2:00 p.m. – 5:00 p.m. No weekend, holiday, or after-hours bookings are permitted. A

minimum of 24 hours’ notice is required for all elevator reservations.

Management will make every effort to proactively communicate with residents, owners, and

tenants of Westgate. However, the relationship between the Corporation/Management and the

owner is separate from the relationship between the owner and tenant. Owners must provide

tenants with a copy of the Rules and Regulations. Tenants should contact their owner directly for

concerns unless it is an emergency (e.g., fire, flood, etc.). Owners are responsible for sharing all

notices, such as alarm testing, policy updates, and notice of entry, with their tenants. Management

reserves the right to enforce the appropriate lines of communication when needed.It's been about a year since the building started to have occupancy, and we would like to ensure

our records are up to date. If there have been any changes in occupancy in your unit, please

complete the Resident Information Form and return it as soon as possible.

If you have rented your unit, please ensure that I have received the lease agreement and the

Resident Information Form. I have had the opportunity to work with several owners who have

rented their units and already provided this information. If you are not sure, please let me know,
